Private Companies Can Use EB-1B to Sponsor Researchers

Private companies with established research teams can sponsor qualifying scientists and engineers through EB-1B, a first-preference employment-based green card category often associated with universities. The route does not require PERM labor certification, but both the researcher and the employer’s research operation must satisfy detailed federal requirements.

Why Employers Overlook EB-1B

EB-1B, formally the outstanding professor or researcher classification, is not limited to academic employers. A qualifying department, division, or institute within a private company may file Form I-140 for a researcher offered a permanent position in an academic field. Unlike EB-1A extraordinary ability, however, EB-1B requires a sponsoring U.S. employer and cannot be self-petitioned.

The exemption from labor certification is significant. Employers do not have to complete the Department of Labor recruitment process generally associated with PERM-based green cards. The company must still provide a qualifying job offer and demonstrate its ability to pay the offered wage.

What the Researcher Must Prove

The beneficiary must have at least three years of teaching or research experience and be internationally recognized as outstanding in the specified academic field. Federal regulations require evidence meeting at least two of six categories, including major awards, selective memberships, published coverage, judging others’ work, original research contributions, or scholarly authorship.

Meeting two categories is not necessarily enough by itself. U.S. Citizenship and Immigration Services also evaluates the evidence as a whole to determine whether the person is genuinely recognized internationally as outstanding. Comparable evidence may be submitted when the standard criteria do not readily apply, which can matter when proprietary or confidential industry research limits traditional academic publishing.

What the Company Must Establish

A private employer must offer a permanent research position through a qualifying department, division, or institute. Under the regulation, that unit must employ at least three people full time in research positions and have documented accomplishments in an academic field. The company therefore needs evidence about the research group itself, not only the sponsored employee’s achievements.

“Permanent” generally means employment of indefinite or unlimited duration with an ordinary expectation of continued employment. Employers should clearly document the position’s research duties, the unit’s staffing and accomplishments, and how the offered work relates to the researcher’s academic field.

Visa Availability Still Matters

An approved EB-1B petition does not automatically produce an immediate green card. In the November 2026 Visa Bulletin, EB-1 final action dates were current for most countries, while the cutoff was August 1, 2023, for mainland China and February 1, 2023, for India. Researchers should separate petition eligibility from visa availability when planning around F-1, OPT, H-1B, or another temporary status.
