Proving Employer-Employee Relationship: The main challenge of starting a business as an H-1B holder lies in demonstrating an authentic employer-employee relationship. When submitting the H-1B petition, you need to provide information about the employment relationship and ownership shares to prove that the employer has control over the employee (the H-1B applicant). It can be difficult to prove it if the H-1B applicant owns the company.
If your company is E-Verified, you own less than 50% of its shares, and you can demonstrate that the job is related to your field of study, it might be worth a try. However, due to the complicated process and low approval rate, it is not a viable option for most people.
