This article discusses what to consider when renewing an H-1B visa and what documents you need to prepare.
H-1B Visa Renewal
If your H-1B status is still valid and there are no significant changes to your employer or employment conditions, you do not need to resubmit Form I-129 for a visa renewal. Instead, you only need to complete Form DS-160 online and schedule a visa interview, just as you did with your initial visa application.
H-1B Visa Renewal Process
-
Submission of Form I-129: Your employer must submit Form I-129 to USCIS on your behalf.
-
Document Preparation: You may need to provide recent pay stubs, proof of employment, and previous H-1B documentation.
-
Receipt of Application: Once your materials are received, USCIS will issue a receipt, marking the start of the pending period.
In an update from October 17, 2023, the U.S. Department of State sent a notice to the Office of Information and Regulatory Affairs titled “Pilot Program to Resume Renewal of H-1B Nonimmigrant Visas in the United States for Certain Qualified Noncitizens.” The notice indicates that the Department of State plans to start the pilot program in early 2024, allowing up to 20,000 in-country renewals during the trial period. If successful, the number of H-1B in-country renewals is expected to increase in 2025.
Notes
-
Apply for your renewal before your current visa expires to avoid any issues.
-
If you change employers, you must submit a new H-1B application, which involves additional steps.
