The H-1B Cap-Gap refers to the extension of OPT from submitting H-1B petition to September 30 (the earliest start date for H-1B is October 1). If you are selected for H-1B and submit your application while your F-1 status is still valid, you can continue to work in the U.S. during H-1B Cap-Gap. This extension is automatic, so you do not need to apply separately.
If you want to ensure this extension, you can request a new I-20 marked with the H-1B Cap-Gap from your previous school once you receive your H-1B submission receipt. The school will update your status to H-1B Cap-Gap in the SEVP Portal, which will synchronize with the USCIS system. This helps prevent the school from accidentally terminating your SEVIS record.
If your H-1B application is withdrawn, canceled, or denied during the Cap-Gap period, you will have a 60-day grace period starting from the USCIS notification date or the expiration of your F-1 status, whichever is later.
If your H-1B application is submitted during the 60-day OPT grace period, you cannot work in the U.S. during the pending period, but you can stay in the country until October 1, when the H-1B takes effect.
What If You Haven't Received H-1B Results by October 1?
The H-1B Cap-Gap ends on September 30. If you have not received your H-1B application result by then, you must stop working from October 1. However, you can stay in the U.S. while waiting for the decision.
Re-Entry Issues During the H-1B Cap-Gap Period
If there is no urgent need, applicants should avoid traveling during H-1B Cap-Gap. Technically, you remain under F-1 status until your H-1B becomes effective on October 1. If you need to travel internationally, you will need to obtain an H-1B visa before re-entering the U.S. Since the Cap-Gap is a transitional period between F-1 and H-1B, most companies would advise employees to avoid travel during this time. If travel is necessary, it is safer to have an updated I-20 marked with H-1B Cap-Gap.
