S4 Blog: Full-Time CPT and Your Future OPT: The 12-Month Rule Explained

CPT and OPT are different benefits, and using a lot of one can affect the other. This is one of the most misunderstood rules among Day-1 CPT students.

A student who uses 12 months or more of full-time CPT generally becomes ineligible for post-completion OPT at the same educational level. Part-time CPT does not trigger that limit. CPT is not an unconditional substitute for OPT.

Full-time vs. part-time
SEVIS defines full-time CPT as more than 20 hours per week and part-time as 20 hours or less. The authorization must state which one applies. The rule counts time authorized as full-time CPT.

Full-time CPT Part-time CPT
Hours More than 20 per week 20 or fewer per week
Effect on OPT 12+ months at one degree level eliminates post-completion OPT at that level Does not count toward that limit

Scope and exceptions

  • The limit applies at the same educational level (for example, master's). Study in the States notes students become eligible for an additional 12 months of OPT when they change to a higher educational level.

  • Checking how your own history counts (earlier degrees, earlier CPT, STEM extensions) needs a DSO or a qualified immigration professional.

What the August 2026 SEVP guidance did and did not change

The August 2026 broadcast messages concern how DSOs evaluate whether CPT is integral to the curriculum. According to Day1CPT.org's summary, they did not create a new OPT eligibility formula.

Why planning matters

  • Many students expect to use OPT and STEM OPT after graduating. Using 12 months or more of full-time CPT may remove that option for the same degree level.

  • A statement such as "use full-time CPT for the whole program and you will not need OPT" leaves out this rule.

  • Policy and school practice can change, so do not treat any plan as guaranteed. Neither CPT nor OPT guarantees a future H-1B.

Questions to ask your DSO

  1. How many months of full-time CPT will my plan use at this degree level?\

  2. Could part-time CPT meet my work goals?

  3. How will my earlier CPT or OPT be counted?

  4. Does my school's current CPT policy limit how long I can use CPT?

Bring a month-by-month plan to your DSO or a qualified immigration professional before you choose full-time CPT.
