S2 Q&A If I file an I-539 (extension of stay or COS), can I keep working while it's pending?

 You generally don’t need to file an I-539 extension just for this reason. A federal court blocked the new DHS rule before it took effect, so the previous Duration of Status (D/S) framework still applies. If you need an EOS for another reason, confirm with your DSO before filing, as CPT may generally continue while a timely EOS is pending.
